“MONTHLY WINNER’S GIVEAWAY” PROMOTION RULES

1. The promotional period (the “Promotional Period”) for “Monthly Winner’s Giveaway“ (the “Contest”) starts at 12:00:01 AM PT on the first day of each calendar month, and continues until 11:59:59 PM PT on the last day of each respective month (the “Contest Closing Date”). No purchase necessary. Void where prohibited by law. Entrants residing in areas where the contest is void are ineligible to win prizes. Must be 18 years of age or older to participate.

2. To Enter: Visit www.mark-taylor.com/winners.htm and fully complete the on-line entry form and receive one entry to the Contest.

3. A random monthly draw, conducted by Vortaloptics and Mark-Taylor Residential, from all eligible entries received during the Promotional Period of the previous calendar month will be conducted on the 5th business day of the following calendar month at approx. 3:30 PM PT in Las Vegas, NV. Odds of winning depend on the number of eligible entries received. Before being declared a winner, the selected entrants must be successfully contacted telephone or email in order to attempt to verify their contact information. Selected entrants will be contacted by telephone at the telephone number indicated on their online entry form within three (3) business days of the drawing. Only one prize per person will be awarded.

4. If a selected entrant cannot be reached personally, without leaving a message, within seven (7) business days of the first phone call made and after a minimum of three call attempts by the Contest administrator or if the entrant declines the prize, or does not otherwise comply with these “Monthly Winner’s Contest Rules (“Rules”), another random draw or draws will be conducted to select replacement entrants in the same manner.

5. If the identity of an on-line entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this contest will be the Contest server machine(s).

6. There will be two (2) or more monthly prizes awarded for each Promotional Period, each consisting of one of the prizes listed on the Contest web page during the Contest Period. The odds of being selected are dependent on the total number of eligible entries received by the Contest Closing Date for each Promotional Period.

7. All prizes must be accepted as awarded and may not be transferred (other than as allowed for herein), or exchanged and have no cash surrender value. Contest Sponsors reserve the right to substitute a prize of equal or greater value in the event of the unavailability, for whatever reason, of the advertised prizes.

8. Winners may be requested to return a signed Declaration and Release of liability and publicity within a specified period of time, before being entitled to a prize, failing which the prize will be forfeited. Decisions by the independent judging organization are final and without appeal in all matters related to this Contest and the awarding of prizes.

9. By entering this Contest, each entrant consents to the use of his/her entry, name, geographical location and/or photograph in any publicity carried out by the Released Parties and/or their advertising agencies, without further compensation. All entries become the property of The Contest Sponsor and will not be returned.

10. This Contest is open to residents of the city of Phoenix (individuals who dwell in the city for two months or longer per year), who are over the age of 18, excluding employees of the Released Parties and their respective affiliated companies, agents, advertising and promotional agencies, prize suppliers and Contest judges, and all those with whom they are domiciled. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.

11. No communications will be entered into except with the selected entrants who will be notified by telephone.

12. The Released Parties assumes no responsibility for lost, stolen, delayed, damaged, illegible or misdirected entries or entries that have been submitted through illicit means, or do not conform to or satisfy the Rules or for failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from any use, interaction with or downloading of any material in the promotion. The Contest Sponsor reserves the right, in its sole discretion; to cancel or suspend the e-mail portion of this Contest should a virus, bug or other cause beyond the reasonable control of The Contest Sponsor corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Released Parties reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Contest Sponsor is not responsible for any errors or omissions in printing or advertising this Contest.

13. The Contest Sponsor is collecting personal data about entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by entrants unless entrants provide explicit permission to do so as indicated on the online entry form.

14. By entering this Contest, entrants release and hold harmless the Released Parties from any liability in connection with this Contest or, if declared a winner, the prize(s). This Contest will run in accordance with these Rules, subject to amendment by The Contest Sponsor. Contestants must comply with these Rules, and will be deemed to have received and understood the Rules if they participate in the Contest.
